The following apply: Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU), Law 34/2002 on Information Society Services and Electronic Commerce (LSSI) and Regulation (EU) 2016/679 (GDPR).
The contract is formalised in Spanish. It is deemed concluded upon confirmation of payment by Omicalabs, S.L.

4. Prices, taxes and payment methods
All prices are in euros (EUR) and include applicable taxes.
Healthcare services provided to individuals are exempt from Value Added Tax under Article 20.one.3 of Law 37/1992. Where the price is shown at 0 % VAT by exemption, no amount is added.
Accepted payment methods:

Payment is processed by an authorised payment institution (Getnet/Redsys). Omicalabs does not store or have access to full card details, which are entered directly into the payment institution’s secure gateway.
Omicalabs issues the corresponding invoice, which the customer may download or request by email.
5. Shipping policy
Shipping area: mainland Spain and the Balearic Islands. For other destinations, please enquire before purchasing.
The kit is shipped within 48 to 72 hours of payment confirmation, and in any case within a maximum of 30 calendar days from conclusion of the contract.
The kit includes the sample collection device, instructions, the informed consent form to be signed and returned with the sample, and prepaid return packaging.
The customer has 30 days from receipt of the kit to collect and return the sample. After that period without return, the order will be deemed withdrawn under section 7.
Shipping and sample return costs are included in the price, unless expressly stated otherwise in the product page.
6. Turnaround time
Results are delivered approximately four weeks after the sample is received by the laboratory, unless a different period is stated in the service page.
If the sample is insufficient, degraded or invalid, the customer will be informed and a replacement kit will be sent at no additional cost.
7. Right of withdrawal
In accordance with Articles 102 et seq. of the TRLGDCU, consumer customers have the right to withdraw from the contract within 14 calendar days without giving any reason and without penalty.
Period: 14 calendar days from receipt of the kit, or from conclusion of the contract where the service does not involve delivery of goods.
How to exercise it: by email to info@omicalabs.es stating your details, the order number and your decision to withdraw, or by using the form in section 8. Use of that model form is not mandatory.
Effects: Omicalabs will refund all payments received, including shipping costs, within a maximum of 14 calendar days from notification of withdrawal, using the same payment method, unless otherwise agreed. The refund may be withheld until the unused kit is received or the customer provides proof of return.
Exceptions (Article 103 TRLGDCU). The right of withdrawal does not apply to:
- Services fully performed, where performance began with the customer’s prior express consent and with their acknowledgement that, once the contract has been fully performed, they lose the right of withdrawal (Art. 103.a). In a genetic test, performance begins when the laboratory receives and processes the sample.
- Sealed goods unsuitable for return on health or hygiene grounds that have been unsealed after delivery (Art. 103.e). The sample collection kit is sealed for health and hygiene reasons: once opened or used, it is not subject to withdrawal.
8. Model withdrawal form
To the attention of Omicalabs, S.L., C/ Puerto Linera 14, 28935 Móstoles (Madrid), info@omicalabs.es:
I hereby give notice that I withdraw from my contract of sale of the following goods or service: ______________________________.
Order number: ____________. Date received: ____________.
Name and surname of the consumer: ______________________________.
Address of the consumer: ______________________________.
Signature (only if submitted on paper): ____________. Date: ____________.
9. Returns and refunds policy
For tests not yet started, the customer may request a return within 14 calendar days of receipt, provided the kit is sealed and unused. The refund is made using the same payment method within a maximum of 14 calendar days from receipt of the returned kit.
If the order cannot be performed for reasons attributable to Omicalabs, the full amount is refunded, including shipping costs.
To request a return: info@omicalabs.es, stating the order number and reason.
10. Warranties and after-sales service
Omicalabs is liable for the conformity of the service in accordance with the TRLGDCU. If the report does not correspond to the service contracted, or if the sample cannot be processed for reasons not attributable to the customer, the analysis will be repeated or the amount refunded, at the customer’s choice.
Customer service: info@omicalabs.es — +34 913 64 58 35, Monday to Thursday 9:00–18:00 and Friday 9:00–15:00.
Complaint forms are available to the customer and may be requested through any of the above channels.
11. Nature of the service and limitations
The services are informative and support clinical decision-making. The report does not in itself constitute a diagnosis and does not replace the assessment of a doctor or other healthcare professional.
Some tests require a prescription or request from a healthcare professional; in such cases this is indicated on the service page and verified before analysis begins.
Genetic results may have implications for the customer’s relatives, who are free to decide whether to share them.
12. Data protection
The processing of personal data, including genetic and health data, is governed by the Privacy Policy, available at Privacy policy and cookies.
13. Dispute resolution and applicable law
The relationship is governed by Spanish law. In the event of any dispute, consumers may contact the consumer services of their region or the consumer arbitration boards, and may bring the matter before the competent courts under consumer law.
Omicalabs undertakes to try to resolve any complaint amicably before resorting to legal proceedings. For cross-border disputes, consumers may contact the European Consumer Centres Network (ECC-Net).
Note: the European Online Dispute Resolution (ODR) platform ceased operations on 20 July 2025 under Regulation (EU) 2024/3228 and is therefore not offered as a means of complaint.
